Wyoming · Non-judicial state with redemption · W.S. §§ 34-4-101 to 34-4-113, 1-18-101 to 1-18-115

Wyoming sells first and lets you buy it back, for three months.

A foreclosure by advertisement with no lawsuit: a notice of intent by certified mail at least 10 days before four weeks of newspaper printings, then a sheriff’s sale at the courthouse. The buyer gets a certificate, not a deed. You keep possession and may redeem for three months at the bid plus 10% interest, junior lienholders get 30 more days, and you stay liable for any shortfall.

Anything else true

Three dates decide a Wyoming case. The first newspaper printing, which must come at least 10 days after the notice of intent and starts four weeks of publication. The sale, which sets the price you can buy the home back for. And three months after the sale, when your right to redeem and to stay in the home ends.

Questions people ask about Wyoming foreclosure

Short answers, each one sourced to the statute cited on this page.

How long does foreclosure take in Wyoming?

A typical Wyoming foreclosure runs roughly 153 days from the first missed payment to the sheriff sale. The lender must mail a notice of intent at least 10 days before the first publication, and the sale is published once a week for four consecutive weeks. W.S. 34-4-103 and 34-4-104.

How long is the Wyoming redemption period?

Three months from the date of sale for a home, by paying the sale price plus 10 percent interest and costs, and 12 months for agricultural land. You keep possession during that time. W.S. 1-18-103 and 1-18-104.

Can a Wyoming lender come after me for the shortfall?

Yes. The lender must account to you for any surplus, and you remain liable for any deficiency. W.S. 34-4-113.

What is the Wyoming homestead exemption?

It is $100,000, but it does not defeat a mortgage you signed. W.S. 1-20-101.

The county sells a tax lien each September, and the holder can apply for a tax deed after four years. You can redeem until a valid tax deed application is filed and accepted, paying 3 percent plus 15 percent a year. W.S. 39-13-108 and 39-13-109.
